DISCLAIMER & LIABILITY WAIVER

By participating in Forest Minds activities, you acknowledge and agree to the following terms. This document serves to inform you of risks, responsibilities and your voluntary assumption of those risks.

 

1. Voluntary Participation and Assumption of Risk

1.1 You acknowledge that participating in Forest Minds activities, which include walking in natural areas, is voluntary and involves inherent risks. You freely and voluntarily assume all risks of injury, damage or loss.

1.2 Outdoor activities entail known and unforeseen risks, including but not limited to: physical or emotional injury, paralysis, death, property damage or harm to third parties. These risks cannot be entirely eliminated without compromising the essential nature of the activity.

1.3 Risks include, but are not limited to: slipping and falling, falling objects, water hazards, exhaustion, exposure to weather extremes (hypothermia, heat-related illnesses, sunburn, dehydration), encounters with wildlife or insects, hazardous plants, remote locations without immediate medical assistance, food or drink consumption, equipment failure, improper lifting, personal physical condition and the exertion involved.

 

2. Responsibilities and Limitations of Staff

2.1 Forest Minds staff strive to maintain safety but are not infallible. They may not know your fitness level or abilities, could misjudge environmental conditions, provide incomplete warnings or use equipment that malfunctions.

2.2 Participation requires your cooperation and adherence to guide instructions and safety protocols.

 

3. Release and Indemnification

3.1 You expressly agree to assume all risks associated with Forest Minds activities.

3.2 You voluntarily release, discharge, and indemnify Forest Minds, its agents, owners, officers, volunteers, participants, employees and all other representatives from any claims, demands or causes of action, including those alleging negligence.

3.3 If Forest Minds incurs attorney fees or costs to enforce this agreement, you agree to indemnify and hold them harmless for all such fees and costs.

 

4. Insurance and Medical Responsibility

4.1 You certify that you have adequate insurance to cover any injury, illness or damage that may occur during participation or agree to bear the costs personally.

4.2 You accept responsibility for any medical or physical condition you may have and any consequences resulting from your participation.

 

5. Jurisdiction and Governing Law

5.1 Any legal action relating to this waiver must be filed in the Greater Sydney jurisdiction.

5.2 The substantive law of New South Wales applies without regard to conflict-of-law rules.

5.3 If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

 

6. Acknowledgment

6.1 This waiver confirms that participation in Forest Minds activities is voluntary and that you accept personal responsibility for all foreseeable and unforeseen events during the activity, including travel to and from the events.

6.2 You will be asked to sign a Waiver of Liability prior to participation.

6.3 This Agreement is intended to be as broad and inclusive as permitted by law. If any provision is deemed invalid, the remainder remains valid and enforceable.
